Stuart Libicki   return to list

Mr. Libicki received his B.S. degree (summa cum laude, Phi Beta Kappa) from the University of California, Berkeley in 1970 and is a 1973 graduate of Boalt Hall School of Law. Mr. Libicki handles a wide array of litigation and appellate work in the areas of labor and employment law, including pension/fiduciary law, fair labor standards, and wage and hour law. He also handles matters relating to real estate and insurance law (both transactional and litigation).

In Amalgamated Clothing and Textile Workers Union v. Murdock, 861 F.2d 1406 (9th Cir. 1988), Mr. Libicki successfully argued that a constructive trust remedy was appropriate equitable relief to remedy pension plan asset manipulation by the plan sponsor, even though the plan had been terminated and all benefits due by the terms of the plan had been paid to participants. Effectively, the court allowed participants and beneficiaries to recover "ill-gotten profits" from fiduciaries who breached their duty even though the participants suffered no losses.

Mr. Libicki has tried cases on behalf of plaintiffs and defendants, with and without juries, in federal district court. He wins a significant number of his cases on summary judgment motions. He is a member of the Labor and Employment Law Section of the Los Angeles County Bar Association and a Fellow of the American College of Labor Lawyers.
